DMX Faces Drug, Weapons Charges After Airport Incident June 29, 2004
DMX faces drug and weapons charges after he was arrested Thursday night when he and another man were caught allegedly attempting to steal a car in the parking lot of New York's Kennedy Airport.
Before Port Authority police found the 33-year-old rapper (real name: Earl Simmons) and Jackie Hudgins, 41, arguing with the car's owner, DMX had allegedly broken through a parking-lot gate after informing the attendant that he was a government agent, according to the complaint filed in Queens County criminal court. In an adjacent lot, Simmons allegedly stopped another driver and ordered him out of his vehicle, claiming he was an FBI agent. When the driver refused, Simmons forced him out of the vehicle, according to authorities.
Although the initial arrest papers made no mention of weapons or drugs, police found a billy club, 15 to 20 rocks of crack cocaine and an unspecified quantity of Oxycodone and Diazepam in Simmons' vehicle. Both men were charged with criminal possession of a weapon and a controlled substance, and Simmons was also hit with charges of criminal mischief, impersonation, menacing, driving under the influence, and endangering the welfare of a child because the other driver’s 12-year-old daughter was in the car. He faces up to seven years in prison if convicted.
Simmons' defense attorney, Murray Richman, said the altercation was "clearly a misunderstanding,” before his client was arraigned, and added that “it might have been a misperception on the part of the owner of the vehicle." Simmons was on his way to board a flight to Switzerland and then the Netherlands for scheduled performances.
Simmons was moved from the Port Authority police's office on Friday morning and put in the custody of Queens Central booking. Bail was set at $15,000. Both men are scheduled to reappear in court on July 23.
